1. Agreement to Terms

By accessing or using GutGraph ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By creating an account, you represent that you are at least 13 years of age and have the legal capacity to enter into a binding agreement.

2. Description of Service

GutGraph is a digestive health tracking application that provides tools for:

• Menstrual cycle tracking and prediction
• Symptom and mood logging
• Nutrition tracking
• Health insights and pattern analysis
• AI-powered nutritional analysis

The Service is designed to help you track and understand patterns in your health data. It is an informational tool and not a medical device or diagnostic tool.

3. User Accounts

Account Creation

• You must provide accurate, complete, and current information when creating an account
• You are responsible for safeguarding your account password
• You must notify us immediately of any unauthorized access to your account
• You may not use a username that is offensive, misleading, or infringes on others' rights

Account Responsibilities

• You are responsible for all activities that occur under your account
• You must keep your login credentials confidential
• You agree to accept responsibility for any and all activities or actions that occur under your account

4. Subscription Plans and Payment

Available Plans

• Basic (Free): Core cycle tracking features, basic logging, AI nutrition logger, limited historical data access
• Premium (Paid): Advanced analytics, unlimited history, data export, full feature access

Billing

• Billing Cycles: Premium subscriptions are available on monthly or annual billing cycles
• Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Price Changes: We will notify you of any price changes at least 30 days before they take effect
• Taxes: Prices may be subject to applicable taxes based on your location

Cancellation and Refunds

• Cancellation: You may cancel your subscription at any time through your account settings or Stripe's customer portal
• Effect of Cancellation: Your subscription will remain active until the end of the current billing period
• Refunds: Refunds may be provided at our discretion for annual subscriptions cancelled within 14 days of purchase
• No Partial Refunds: We do not provide partial refunds for unused portions of monthly subscriptions

Free Trials

• We may offer free trials for Premium features
• You may be required to provide payment information to start a free trial
• If you do not cancel before the trial ends, you will be charged for the subscription

5. Acceptable Use

You agree to use GutGraph only for lawful purposes and in accordance with these Terms.

You Agree NOT To:

• Use the Service for any purpose other than personal health tracking
• Share your account credentials with others
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers
• Use automated systems or software to extract data from the Service
• Upload malicious code or content
• Impersonate another person or entity
• Use the Service to harass, abuse, or harm others
• Violate any applicable laws or regulations

6. Intellectual Property

Our Content

The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of GutGraph and its licensors. The Service is protected by copyright, trademark, and other laws.

Your Content

You retain ownership of any health data you provide to the Service. By using GutGraph, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service to you.

7. Limitation of Liability

No Warranty for Health Outcomes

• We make no guarantees about the accuracy of cycle predictions or health insights
• Nutritional estimates from AI analysis are approximations and may contain errors
• We are not responsible for any health decisions you make based on data from the Service
• You acknowledge that health tracking data should be used for informational purposes only

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We are not liable for any losses resulting from service interruptions, data loss, or technical issues.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from using the Service will be accurate or reliable
• The quality of any information obtained through the Service will meet your expectations
• Any errors in the Service will be corrected

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

• By You: You may terminate your account at any time through account settings
• By Us: We may terminate accounts that violate these Terms or remain inactive
• Effect: Upon termination, your right to use the Service will immediately cease
• Data Deletion: After termination, your data will be deleted per our Privacy Policy

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GutGraph operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration, except where prohibited by law.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days' notice before any material changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
